TERMS & CONDITIONS.
The terms that apply to using this website and taking part in the New England States Rivalry Challenge.
Effective date: October 1, 2025
These Terms & Conditions ("Terms") govern your use of www.nerivalry.com (the "Site") and participation in the New England States Rivalry Challenge ("NESRC" or the "Tournament"), operated by New England Hockey Group LLC ("New England Hockey Group," "we," "us," or "our"). By using the Site, submitting a form, registering, or attending or participating in the Tournament, you agree to these Terms. If you do not agree, do not use the Site or participate.
1. WHO MAY USE THE SITE AND REGISTER
You must be at least 18 years old to submit forms, register or make purchases. A parent or legal guardian must complete all player inquiries and registrations for players under 18, and by doing so accepts these Terms on the player's behalf.
2. SITE USE
You agree not to misuse the Site, including by submitting false information, interfering with its operation, attempting unauthorized access, or copying or scraping its content. The Site and its content, including the NESRC name, logos, photos, graphics and text, are owned by or licensed to New England Hockey Group and may not be used without our written permission.
Information on the Site, including schedules, scores and statistics, is provided for general information. We work to keep it accurate but do not guarantee that it is complete, current or error-free, and official tournament records control.
3. REGISTRATION AND TEAM PLACEMENT
Submitting a player inquiry does not guarantee a roster spot. Team selection, roster placement, and positions are decided by the Tournament and its state team staff at their sole discretion. We may decline or cancel any registration at our discretion, including for false information, unpaid fees, or conduct that violates these Terms. Players and teams must meet all eligibility and documentation requirements we set.
4. RULES AND CONDUCT
All players, coaches, team officials, parents and spectators must follow the Tournament rules, rink rules and the instructions of officials and Tournament staff. Our zero-tolerance policy for verbal abuse applies to everyone, for the entire Tournament. We may remove anyone from a game, the facility or the Tournament for unsafe, abusive, unsportsmanlike or disruptive conduct, without refund. Decisions of game officials and the Tournament Director are final.
5. ASSUMPTION OF RISK
Ice hockey is a contact sport with inherent risks, including falls, collisions, contact with pucks, sticks, skates, boards and other players, and other hazards that may result in serious injury, illness, permanent disability or death. Each participant, and each parent or guardian of a minor participant, understands these risks and voluntarily assumes all of them, whether known or unknown. Players must wear all protective equipment required by the Tournament rules and USA Hockey.
6. RELEASE AND WAIVER
To the fullest extent permitted by law, each participant, and each parent or guardian on behalf of themselves and their minor participant, releases, waives and agrees not to sue New England Hockey Group LLC, its owners, staff, volunteers, coaches, officials, partners and host facilities for any injury, illness, loss or damage arising from participation in or attendance at the Tournament, including claims arising from ordinary negligence. Each participant and their parent or guardian must also sign the Tournament's separate participant waiver and release, which is incorporated into these Terms; if the two conflict, the signed waiver controls.
7. MEDICAL TREATMENT
If a participant is injured or becomes ill during the Tournament and a parent or guardian cannot be reached, the parent or guardian authorizes Tournament staff and facility personnel to obtain emergency medical treatment for the participant. The parent or guardian is responsible for all resulting costs.
8. PHOTO, VIDEO AND NAME USE
Tournament games and events may be photographed, filmed, recorded or live-streamed. By participating or attending, you grant New England Hockey Group and its partners permission to use participants' names, jersey numbers, likenesses, images, voices and game statistics, in any media, for Tournament records and to promote the Tournament, without compensation. To request removal of a specific image from our Site or social media, email info@nerivalry.com.
9. SCHEDULE AND EVENT CHANGES
We may change schedules, game times, game lengths, rinks, formats, divisions and team placements at any time, including on the day of play. Refunds are governed only by our Refund Policy.
10. PERSONAL PROPERTY
New England Hockey Group is not responsible for lost, stolen or damaged equipment, clothing or personal belongings at any facility.
11. THIRD-PARTY SERVICES
The Site may link to or use third-party services, such as scoring and statistics platforms, payment processors and social media. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.
12. DISCLAIMER OF WARRANTIES
The Site and Tournament are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, New England Hockey Group will not be liable for any indirect, incidental, special, consequential or punitive damages. Our total liability for any claim relating to the Site or the Tournament will not exceed the amount you paid to us for the Tournament in the twelve months before the claim arose.
14. INDEMNIFICATION
You agree to defend, indemnify and hold harmless New England Hockey Group LLC, its owners, staff, volunteers and partners from any claims, damages and expenses, including reasonable attorneys' fees, arising from your or your minor participant's conduct, violation of these Terms, or violation of any law or the rights of another person.
16. GENERAL
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. We may update these Terms at any time by posting a revised version on this page with a new effective date; continuing to use the Site or participate means you accept the changes.
